These Terms and Conditions define the general rules of sale applicable in our online store available at: <https://melexpo.eu/>, operated by **Mel-Expo Emilia Statucka-Sklepik**, ul. Szamotulska 6, 64-514 Pamiątkowo, NIP: PL7871934525, REGON: 528069017. The business is registered in the Central Registration and Information on Business of the Republic of Poland (CEIDG).

### **Scope of Terms and Conditions**

These Terms apply to all orders placed by Consumers and Entrepreneurs via our online store.

- A **Consumer** is, under Art. 22 of the Civil Code, a natural person performing a legal transaction with an entrepreneur not directly related to their business or professional activity.
- An **Entrepreneur** is, under Art. 43 of the Civil Code, a natural or legal person, or an organizational unit with legal capacity, conducting business or professional activity in their own name.

Other or additional terms and conditions used by Entrepreneurs do not apply—unless we give express written consent.

### **Contract Conclusion**

The sales contract is concluded with **Mel-Expo Emilia Statucka-Sklepik**.

The product presentation in our online store is an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code. To submit a purchase offer, you must place an order. You can add selected products to your cart and edit them before submitting. Finalizing the order by clicking the confirmation button constitutes an offer to buy.

After placing the order, you’ll receive an email confirming receipt and acceptance of your order. The sales contract is concluded upon receiving this email.

### **Language and Archiving**

Sales contracts can be concluded in **Polish, English, German, French, or Spanish**.

We store the contract and send you the order details and a copy of the Terms and Conditions by email. You may also access your order history via your customer account. The Terms are available on our website for download, saving, and printing.

### **Product Delivery**

The order processing time is **5–14 working days** from payment confirmation and approval of print files.

Orders are shipped via our partner courier services. Detailed shipping methods, costs, and delivery times are shown during checkout and in the shipping info section.

- **Shipping only** — personal pickup is not available.
- **No parcel locker delivery (InPost, etc.)**

### **Payments**

We offer the following payment method:

- **Bank transfer**: You’ll receive payment details via email after placing your order. We begin processing once full payment is received.

### **Right of Withdrawal**

A **Consumer** may withdraw from the contract within **14 days** without stating a reason and without incurring costs, except those specified in Articles 33 and 34 of the Consumer Rights Act.

This right also applies to natural persons entering into contracts directly related to their business when it’s not professional in nature. Other Entrepreneurs do **not** have the right to withdraw.

### **Retention of Ownership**

Ordered products remain our property until full payment is received.

### **Transport Damage**

For **Entrepreneurs** (excluding sole proprietors acting as consumers): The risk of accidental loss or deterioration passes to the buyer upon product handover to the shipping carrier. We are not liable for damage or delays caused by the carrier.

### **Complaints: Conformity &amp; Defects**

We are obligated to deliver goods **free from defects**. If the product does not conform to the contract, Consumers are entitled to remedies under Chapter 5a of the Consumer Rights Act, including:

- Repair or replacement
- Price reduction
- Withdrawal from the contract

We are liable for any lack of conformity that appears within **2 years** of delivery, unless otherwise specified.

**Complaint response time: max. 14 working days**

The same rights apply to sole proprietors if the purchase is not of professional nature.

**Complaint process includes:**

- Formal registration and analysis
- Acceptance or rejection
- Proposal of resolution
- Customer agreement and closure, or escalation
- Corrective actions if applicable

Additional warranty info, if available, is included with the product or on our website.

For **Entrepreneurs**: Warranty liability is excluded based on Art. 558 § 1 of the Civil Code (unless stated otherwise).

### **Electronic Services**

To use our store, including browsing and ordering, you need a multimedia device with internet access and an email account. Users must use the store legally and ethically. Illegal content is strictly prohibited.

We aim to ensure technical functionality and quickly resolve any issues reported by users. This applies to newsletter signup or customer account creation if those services are offered.

### **Out-of-Court Dispute Resolution**

Consumers may use **alternative dispute resolution (ADR)** methods. Information is available at:

ADR is voluntary and requires consent from both sides. We agree to ADR with consumers under the Polish Act on Out-of-Court Consumer Dispute Resolution.

### **Final Provisions**

Nothing in these Terms limits your statutory Consumer rights. If any provisions conflict with legal Consumer rights, legal regulations take precedence.

For **Entrepreneurs**, Polish law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

For disputes with **Entrepreneurs**, legal persons, or public entities, the competent court is the one for our registered office (unless otherwise stated for sole proprietors).
